General Terms and Conditions of Business of Alpenfreifall GmbH valid as of 2014
1. Conclusion of a contract
A contract is concluded between the customer and Alpenfreifall GmbH for all services. The following General Terms and Conditions of Business (GTCB) form the basis of this contract. No terms and conditions of business deviating from or opposing these conditions will be acknowledged, unless we expressly confirm them in writing. We presume that, upon making a reservation, you have read and understood this sheet, and accepted its terms and conditions. If you are giving a third party one of our services as a gift, please make sure you give them a copy of our GTCB and point out the importance of reading them.
Please see our current price lists. Prices include VAT at the tax rate applicable in Austria. If there are any mistakes in our prices or if any of the product information is incomplete, we reserve the right to make corrections. We will inform customers immediately upon detection of the error and inform them about the change to the new information. The customer may then reconfirm the order or cancel the contract.
3. Jump tickets
Jump tickets are available online at: https://www.alpenfreifall.at/en/order-voucher/ or by telephone. All jump tickets are available for 24 months from the date of issue. If the event has been cancelled several times (at least 6x) during the past six months due to inclement weather, we will extend the ticket for a further six months free of charge. This only applies to tickets issued by Alpenfreifall GmbH. For the validity of tickets and/or vouchers from our marketing partners, see their General Terms and Conditions of Business. Please ask your sales partner about the precise period of validity.
4. Terms of payment
When sending jump tickets by post, we retain ownership of the jump tickets until payment in full has been received. By placing the order, the purchaser of an Alpenfreifall ticket is obliged to pay the purchase price within 7 days of receipt of the ticket (net).
We send tickets free of charge by post. We are not liable for any delays or risk of loss or damage. If your ticket gets lost, please inform us as soon as possible so that, against the signing of a declaration of loss, we can issue a replacement.
We are not liable for any misuse caused by lost tickets.
6. Cooling-off period and right of return
You can cancel your order within 14 days of receipt of the ticket in writing, sent by post, without citing the reasons. Please return the ticket. The punctual posting of the ticket suffices as compliance with the time limit.The customer bears the costs for returning the ticket(s).
7. Availability proviso
If, following the conclusion of a contract, Alpenfreifall GmbH ascertains that the service is no longer available or can no longer be performed for legal reasons, Alpenfreifall GmbH may withdraw from the contract. Any payments already received will be reimbursed immediately.
Registration in advance is a basic necessity. Depending on the desired event, this registration should be made online at least two to four weeks before the date of the event at: https://www.alpenfreifall.at/en/book-jump/. We will gladly answer any questions on the telephone.
Please see our online calendar at https://www.alpenfreifall.at/en/book-jump/ for free dates on which you can reserve our services. Since all of our events depend on the weather, we sometimes have to cancel and postpone them. This happens on the day of your reservation at the latest. Only the management of Alpenfreifall GmbH is authorised to make such cancellations. We reserve the right to cancel for inclement weather or technical reasons at short notice. We are not liable for any travel costs or other costs in the event of cancellations.
10. Cancellation of the jump reservation
If you are unable to keep your reservation (the precise booked time is the deadline), please inform us as early as possible by “short message” (00436506803844) or mail (firstname.lastname@example.org). Cancellation up to three days before the planned jump is not subject to a cancellation fee. After this, a cancellation fee of €50 per person applies. Alpenfreifall GmbH vouchers/tickets lose their validity upon cancellation and are reactivated by us upon receipt of your cancellation fee. The purchase price is non-refundable. The same applies to vouchers/tickets of our marketing partners. It is no longer possible to make a cancellation from the date of your jump. In this case, the cancellation fee is 100%. Vouchers and tickets are therefore calculated as “no shows”, and if the jump is to be paid in cash on the day (because you did not provide a ticket / voucher number), we will charge the full amount of the jump. If the validity period of your voucher/ticket has expired, we will charge you the full amount for the jump and will jump with you. We do not check the validity of your voucher (jump ticket) in advance. The customer is responsible for the validity of the voucher/ticket! If, on the day of the jump, you violate one of the conditions of participation (11.), we will also charge you the full amount of the jump. Naturally, somebody else can take your place at short notice.If you turn up more than 15 minutes late, the cancellation fee also amounts to 100%. Unfortunately, we cannot wait any longer than this for you on booked-up days.
11. Conditions of participation
No unnaturally excessive conditions are required on you physically to participate in our events. Average good health and a stable mental constitution are usually sufficient. There is no upper age limit for participants if the aforementioned is given. The minimum age for engaging in tandem skydives is 13. A declaration of consent from the parent or legal guardian of a minor must be presented. Their signature on the contract of carriage you sign before the jump suffices. The weight of the participant may not exceed 90kg including clothing (approx. 2-3kg) for all events. Weight will be checked on the day using a standard set of scales. Please ask us if you are unsure whether you comply with the physical and mental conditions. In cases of doubt, our responsible employees on site will decide whether you will be able to jump. Furthermore, a “Contract of carriage and liability agreement” must be signed on site. If, on the day of the jump, you violate one of the conditions of participation, we will also charge you the full amount of the jump. In the event of violations against the conditions, the cancellation fee amounts to 100%. Naturally, in such cases, somebody else may take your place.
Within the bounds of statutory provisions, participants in our events / aerial sport equipment and aircraft are insured as follows:
– Personal aviation insurance and passenger personal liability insurance
– Passenger accident insurance
– Personal aviation insurance of the aircraft for physical injury and damage to property
The participant is responsible for any insurance protection over and above this.
13. Exclusion of liability
In conjunction with all our services, we only assume liability for damages resulting from intent or gross negligence on our part. Participants assume liability for damage caused by them unless this damage is covered by the legally prescribed insurances. The participant is responsible in full for cases of damage resulting from intent, gross negligence or violation of legal provisions. In the event of third-party services, the separate liability and participation conditions of the pertinent organiser apply.
We want all of our events to be an experience as well as a pleasure for you. For this reason, please schedule-in enough time to get here, for preparing yourself before the jump and for winding down afterwards, as well as for any potential delays. Generally, you can reckon with half a day for all activities. Please ensure that you do not drink any alcohol, including the night before, make sure you have a good night’s sleep and eat a good breakfast. Alpenfreifall GmbH or an organiser on site entrusted with the task will provide you with the necessary equipment. Wear comfortable clothing and trainers befitting the season. The schedule and the organisation of the aircraft at the location are regulated exclusively by our representatives, who will gladly take your wishes into consideration if possible.
15. Data protection
The data necessary for the business transaction are processed and stored by means of an EDP system. Naturally, personal data will be treated confidentially, and will not be forwarded to unauthorised third parties. Alpenfreifall GmbH reserves the rights of use to the photos and videos for all media (print, press, Internet and film).
16. Choice of law
Austrian law applies to the legal relationships between AlpenfreifallGmbH and its customers as well as to the pertinent terms and conditions of business. Place of jurisdiction is Gmunden.
17. Severability clause
If individual provisions of these General Terms and Conditions of Business are invalid or unfeasible, or become invalid or unfeasible, the validity of the other provisions will not be affected.In this case, the parties to the contract are obliged to replace the invalid provision with a valid provision which comes closest to the purpose of the agreement. The same applies if a provision is incomplete.
Liability for content
The contents of our pages were created with great care . For the correctness, completeness and topicality of contents we can not take any responsibility. As a service provider we are responsible according to § 7 paragraph 1 of TMG for own contents on these pages under the general laws. According to § § 8 to 10 TMG we are not obliged as a service provider to monitor transmitted or stored foreign information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information under the general laws remain unaffected . However , a relevant liability is only possible from the date of knowledge of a specific infringement . Upon notification of such violations, we will remove the content immediately.
Liability for links
Our site contains links to external websites over which we have no control. Therefore we can not accept any responsibility for their content. The respective provider or operator of the pages is always responsible for the contents of any Linked Site. The linked sites were checked at the time of linking for possible violations of law. Illegal contents were at the time of linking. A permanent control of the linked pages is unreasonable without concrete evidence of a violation . Upon notification of violations, we will remove such links immediately.

Duplication, processing , distribution and any kind of exploitation outside the limits of copyright require the written consent of its respective author or creator.
